CAS:lta päätös Kenian päättävästä jalkapalloelimestä
Urheilun kansainvälinen välitystuomioistuin CAS on tänään antamallaan päätöksellään todennut, että Keniassa ylin jalkapallosta päättävä elin - ja siten myös FIFA:n jäsen - on Football Kenya Limited (FKL), eikä Kenya Football Federation (KFF), joka oli erotettu vuonna 2006 FIFA:n jäsenyydestä sen sisäisten erimielisyyksien vuoksi.
In support of its appeal, KFF raised two main arguments: (1) that FIFA did not validly expel the KFF and (2) that there was no valid legal succession of KFF by FKL. The CAS found that FIFA rightfully did not apply the provisions of its statutes regarding the expulsion of a member of FIFA considering that it was sufficient for FIFA to accept the binding decisions taken by the bodies representing football in Kenya to replace KFF with FKL, replacement which has also been recognised by the Kenyan government. Furthermore, the CAS noted that the decisions taken by the General Assembly of the KFF on 15 November 2008 have never been challenged by any member of the KFF. In addition, all actions and decisions of FKL and of FIFA following the assembly of 15 November 2008 have remained unchallenged. In the absence of any legal grounds that would entitle the KFF to be recognised as a member of FIFA, the CAS has dismissed the claim of the KFF.Koko päätös: Click here to read the arbitral award rendered by the CAS.
